Delta-8 THC made from hemp is legal in Georgia. In its lawsuit, the company claimed that Boyd Street Distro, based in Los Angeles, had sold counterfeit versions of AK's delta-8 THC products. Delta-8 THC is legal in New Jersey and is not classified as a controlled substance under state law following the passage of Bill A5322, which later became the New Jersey Hemp Program. Delta-8 THC is just one of these compounds, and scientists don't know much about how the chemical isolated in the body works, especially in high concentrations. Unfortunately, authorities cannot verify if companies extract Delta-8 THC directly from hemp or if they produce it synthetically from other cannabinoids. Boyd Street argued, however, that AK Futures' trademark infringement lawsuit was invalid because THC delta-8 is illegal under federal law. Hemp-derived delta-8 is legal in Ohio and is not classified as a controlled substance under state law following the passage of Ohio Senate Bill 57, which legalized hemp and hemp compounds, including delta-8.The psychoactive properties of delta-8 THC have been the subject of controversy over its safety and several states have taken steps to regulate the cannabinoid.

This bill would have limited the amount of all tetrahydrocannabinols to 0.3%, making it nearly impossible to produce effective delta-8 THC products. Delta-8 THC legally remains out of bounds in Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Idaho, Iowa, Kentucky and Michigan (effective October 2002, Mississippi, Montana, New York, North Dakota, Rhode Island, Utah, Vermont and Washington (except DC). The FDA is also concerned that delta-8 THC products may expose consumers to much higher levels of the substance than are naturally produced in raw hemp and cannabis extracts. Delta-8 is not legal in Delaware, which means that the state does not allow the use, possession, sale, distribution and production of Delta-8 products under state law.

In addition, the FDA is concerned about the proliferation of products that contain delta-8 THC and are marketed for therapeutic or medical uses, although they have not been approved by the FDA. With this ruling, the country's cannabis community was quick to assume that this would ban Delta-8 THC and spread panic. However, the bill does not address delta-8 THC levels, an omission that makes it legal for vendors to sell the compound, often as groceries, vaporizer cartridges and tinctures, without supervision.
